Per the state of Wisconsin Division of Gaming office the following rules must be adhered to:

 

  • Tickets can only be sold to individuals. If a buyer puts a mailing address on the ticket stub with two names (Mr. and Mrs. John Smith), one name will need to be crossed off.
  • Distribution of winnings can only be mailed to the individual listed on the ticket stub. If multiple people choose to purchase a ticket together, the winner that is listed on the ticket will be responsible for dividing and distributing the cash prize.
  • Payments, prizes or drawings for sellers of tickets is prohibited.
  • Winner need not be present to win.
  • Tickets must be sold in the state of Wisconsin.
  • The Federal Regulation on Mailing Title 18, United States Code, Section 1302 states that:

Whoever sends by mail…Any Lottery ticket or part; any check etc. for the purchase of a lottery ticket; Any newspaper, circular, pamphlet, or publication of any kind containing any advertisement of any lottery, gift enterprise, or scheme of any kind offering prizes dependent in whole or in part upon lot or chance, or containing any list of the prizes drawn or awarded by means of any such lottery, gift enterprise, or scheme, whether said list contains any part or all of such prizes;

MAY BE FINED OR IMPRISONED OR BOTH.

 

In other words, “You cannot send raffle tickets or checks for the purchase of raffle tickets via United States Postal Service.  Tickets must be sold face to face.”

 

We ask that you abide by these rules as failure to do so may result in the loss of St. Mary’s Springs Academy’s raffle license and/or the occurrence of significant fines.

 

Additional Raffle Information

 

The prize winner of the vehicle shall assume all fees, local, state and federal taxes, sales tax, and financing costs which must be paid prior to the vehicle being transferred to the winner. SMSA takes no responsibility for any tax liabilities or costs. Consult your tax advisor. This offer is void where prohibited by law, and all federal, state, and local laws and regulations apply.

 

By entering this raffle, entrants accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by SMSA or Holiday Automotive for publicity purposes and in lists of prize winners to be published in area newspapers and announced on the SMSA and Holiday Automotive websites and social media outlets. Other rules and regulations may apply. Please contact SMSA if you have questions. SMSA’s interpretation and application of the rules and regulations shall be final.

 

By entering this raffle, each participant releases SMSA, its directors, faculty and staff from any and all liability for injuries, losses or damages of any kind caused by participating in the raffle or winning the vehicle or resulting from acceptance, possession, use or misuse of the prize, and the winner agrees to indemnify and hold SMSA harmless from any and all losses, damages, rights, claims and actions of any kind rising in connection with or as a result of participating in the raffle or the winner’s acceptance or use of the prize.

 

SMSA reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds.”

 

There is no cash value associated with this prize. If the prize winner cannot be located by 5:00 p.m. on April 8, 2020, after making a reasonable attempt to make contact through the information provided at the time of purchasing the raffle ticket, another winner will not be selected for such prize. Should the prize winner decline their prize, the prize will be forfeited and another winner will not be selected.  If the prize winner donates the prize back to SMSA, another prize winner will not be selected.
